Did you know that in case of termination of the employment contract, the employer is obliged to make a final settlement with you?
1․ If the employee is transferred to another job with the same employer or the legal successor recognized in accordance with the law, the employer does not make a final settlement with the employee.
1․1 In case of termination of the employment contract, the employer is obliged to make a full settlement with the employee on the day of termination of the employment contract, unless otherwise provided by this Code, the law or the consent of the employer և the employee.
2․ The employer is obliged to pay the employee’s salary and other payments equal to it on the day of the final settlement, and if that obligation cannot be fulfilled for reasons beyond the employer’s control, the employee’s salary and equal payments shall be made within five working days after the employee submits such claim.
2․1 In the event of the death of an individual employer, the obligation to make a final settlement is transferred to the heirs of the inheritance, and in the absence of heirs or the refusal of the heirs to accept the inheritance to the person or body that accepts the property within its value.
3․ At the request of the employee, the employer is obliged to provide him / her with a reference on job functions (duties), salary, amount of taxes paid and the amount of state social security payments and job evaluation.
